TERMS OF SALE

(governs the purchase of products from BATTAN)

Purpose

These Terms of Sale govern any purchase made on battan.fr. They apply in addition to, and take priority over, our Terms of Service for anything relating to your order.

Products and Pricing

Product descriptions and prices are shown on the website at the time of your order, in EUR. BATTAN operates under the French VAT exemption scheme (franchise en base de TVA, Article 293 B of the French General Tax Code) — no VAT is charged. Shipping costs are shown separately at checkout.

Placing an Order

Placing an order constitutes an offer to purchase. An order is confirmed once payment is processed and you receive a confirmation email. BATTAN reserves the right to decline or cancel an order — including for stock unavailability, payment issues, or suspected fraud — in which case you will be notified and refunded if payment was already taken.

Payment

Payment is due in full at the time of order, processed securely via Shopify's payment system. You confirm that any payment details you provide are accurate and that you are authorized to use the payment method.

Delivery

Delivery zones, rates, and estimated timeframes are detailed in our Shipping Policy. Risk of loss or damage transfers to you only upon actual delivery of the goods — not upon handover to the carrier — in accordance with French consumer law.

Right of Withdrawal

You have 30 days from receipt of your order to withdraw from your purchase without needing to provide a reason, exceeding the 14-day minimum required under EU consumer law. Full conditions and process are detailed in our Return and Refund Policy.

Legal Guarantees

As a consumer, you benefit from mandatory legal guarantees that cannot be excluded or limited:

• Legal Guarantee of Conformity (Articles L217-3 to L217-20 of the French Consumer Code): two (2) years from delivery to invoke this guarantee, with the right to choose repair or replacement, and exemption from proving the defect during the first 24 months.
• Hidden Defects Guarantee (Articles 1641 to 1649 of the French Civil Code): two (2) years from discovery of the defect, with the right to choose cancellation of the sale or a price reduction.

Liability

To the extent permitted by French and EU law, BATTAN's liability for indirect or consequential damages arising from your purchase is limited. This does not apply to, and nothing here excludes, BATTAN's liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded — including your statutory guarantees above.

Governing Law

These Terms of Sale are governed by French law. If you are a consumer residing in another EU member state, this does not deprive you of the protections granted under the mandatory consumer law of your country of residence. Disputes may be submitted to the competent French courts, without prejudice to your right to bring proceedings in the courts of your country of residence where applicable under EU law.
